SJS TERMS

APPLICABILITY & ACCEPTANCE OF THESE TERMS AND CONDITIONS constitute a legal agreement  agreement between you and SJS CARWASHING LLC, a Dubai-based corporation (the “Company”). By using or receiving any services supplied to you by the Company (collectively, the “Service”), or downloading, installing or using any associated application supplied by the Company (collectively, the “Application”), you hereby expressly acknowledge and agree to be bound by the Agreement, and any future amendments and additions to the Agreement as published from time to time at https://sjscarwash.com/terms or through the Application.

SJS Car Washing LLC is a car wash service that allows users to request a car service via the mobile app.

Key Content-related Terms

  • “SJS Car Washing LLC​” maintains the www.sjscarwash.com Website.”
  • “Visa or MasterCard debit and credit cards in AED will be accepted for payment.”
  • “User is responsible for maintaining the confidentiality of his account.”
  • “User” means a person who accesses or uses the Service or Application.
  • “User Content” means Content that a User posts, uploads, publishes, submits or transmits to be made available through the Service or Application.
  • “Collective Content” means, collectively, Company Content and User Content. ​
  • “Content” means text, graphics, images, music, software (excluding the Application), audio, video, information or other materials.
  • “Company Content” means Content that Company makes available through the Service or Application, including any Content licensed from a third-party, but excluding User Content.
  • “Payment Confirmation (for Services)” Once the payment is made, the confirmation notice will be sent to the client via email within 24 hours of receipt of payment.
  • “Cancellation Policy (For Services & Packages)” Customer can cancel their order within 24 hours or before order confirmation; refunds will be made back to the payment solution used initially by the customer. Please allow for up to 10 days for the refund transfer to be completed.

 

USER LICENSE SCOPE.

SJS Car Washing LLC grants you permission (which may be revoked at any time for any reason or no reason) to use the Sites in accordance with these Terms of Use and solely for your own personal, non-commercial use. You may not modify, copy, distribute, re-publish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products or services obtained from the Sites, except as specifically noted above. Except as specifically authorized by SJS Car Washing LLC, you may not deep-link to the Sites for any purpose or access the Sites manually or with any robot, spider, web crawler, extraction software, automated process or device to scrape, copy, or monitor any portion of the Sites or any information, content, or material on the Sites. SJS Car Washing LLC reserves all of its statutory and common law rights against any person or entity who violates this paragraph. You may not link or frame to any pages of the Sites or any content contained therein, whether in whole or in part, without prior written consent from SJS Car Washing LLC. You may like or follow SJS Car Washing LLC or share links to the Sites via social networking technology referenced on the Sites. Any rights not expressly granted herein are reserved.

Conduct of Users:

By entering into this Agreement or using the Application or the Service You agree; not to access the Sites using a third-party’s account/registration without the express consent of the account holder; not to use the Sites of the Services for illegal purposes; not to use the Sites to engage in commercial activities apart from sanctioned use of SJS Car Washing LLC Services; not to copy any content from the Sites for republication in print or online; not to attempt to gain unauthorized access to other computer systems from or through the Sites; not to interfere with another person’s use and enjoyment of the Sites or another entity’s use and enjoyment of the Sites; not to upload or transmit viruses or other harmful, disruptive or destructive files; and/or not to disrupt, interfere with, or otherwise harm or violate the security of the Sites, or any system resources, accounts, passwords, servers or networks connected to or accessible through the Sites or affiliated or linked sites (including those of our partners). SITE CONTENT Nature of User Material. At times, the Sites may allow you and others to post, transmit, display, publish, distribute, or otherwise submit public user generated material including, but not limited to, reviews of the Services offered by SJS Car Washing LLC or its partners (collectively, “Submissions”). You agree not to create any Submission that: contains vulgar, profane, abusive, hateful, or sexually explicit language, epithets or slurs, text in poor taste, inflammatory attacks of a personal,  racial or religious nature, or expressions of bigotry, racism, discrimination or hate; is defamatory, threatening, disparaging, inflammatory, false, misleading, deceptive, fraudulent, inaccurate, or unfair, contains gross exaggeration or unsubstantiated claims, violates the privacy rights or right of publicity of any third party, is unreasonably harmful or offensive to any individual or community, contains any actionable statement, or tends to mislead or reflect unfairly on any other person, business or entity; unfairly interferes with any third party’s uninterrupted use and enjoyment of the Sites; is intended primarily to promote a cause or movement, whether political, religious or other; contains copyrighted content (copyrighted articles, illustrations, images, text, or other content) without the express permission of the owner of the copyrights in the content; constitutes, promotes or encourages illegal acts, the violation of any right of any individual or entity, the violation of laws of the United Arab Emirates, rule, guideline or regulation, or otherwise creates liability; discloses any personal identifying information relating to or images of a minor; infringes any copyright, trademark, patent, trade secret, or other intellectual property right; contains viruses or other harmful, disruptive or destructive files; links to any commercial or other website; and/or is not otherwise in compliance with these Terms of Use.

Representations and Warranties:

Each time you provide a Submission to the Sites, you represent and warrant that you have the right to provide such Submission, which means: you are the author of the Submission, or the Submission is not protected by copyright law, or you have express permission from the copyright owner to use the Submission in connection with the Sites; and you have the right to grant SJS Car Washing LLC the license set out in these Terms of Use; your use of the Sites and Submission(s) do not violate these Terms of Use. User License Grant to SJS Car Washing LLC. You grant SJS Car Washing LLC, its affiliates, and related entities a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, archive, store, publish, transmit, perform, distribute, reproduce and create derivative works from all Submissions you provide to SJS Car Washing LLC in any form, media, software or technology of any kind now existing or developed in the future. Without limiting the generality of the previous sentence, you authorize SJS Car Washing LLC to include the Submissions you provide in a searchable format that may be accessed by users of the Sites. You also grant SJS Car Washing LLC and its and related entities the right to use any Personally Identifiable Information (as that term is defined in SJS Car Washing LLC Privacy Policy) included with any Submission in connection with the use, reproduction or distribution of such Submission and SJS Car Washing LLC’s provision of Services to you. You also grant SJS Car Washing LLC the right to use the Submission and any facts, ideas, concepts, know-how or techniques (“Information”) contained in any Submission or communication you send to SJS Car Washing LLC for any purpose whatsoever, including but not limited to, developing, manufacturing, promoting and/or marketing products and services. You grant all rights described in this paragraph in consideration of your use of the Sites, without compensation of any sort to you. SJS Car Washing LLC does not claim ownership of Submissions.

Disclaimer of Warranties:

THE COMPANY MAKES NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE OR APPLICATION. THE COMPANY DOES NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE OR APPLICATION WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, APPLICATION, SYSTEM OR DATA, (B) THE SERVICE OR APPLICATION WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (C) ANY STORED DATA WILL BE ACCURATE OR RELIABLE, (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (E) ERRORS OR DEFECTS IN THE SERVICE OR APPLICATION WILL BE CORRECTED, OR (F) THE SERVICE OR THE SERVER(S) THAT MAKE THE SERVICE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SERVICE AND APPLICATION IS PROVIDED TO YOU STRICTLY ON AN “AS IS” BASIS. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY THE COMPANY. THE COMPANY MAKES NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, SAFETY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF ANY SERVICES, PRODUCTS OR GOODS OBTAINED BY THIRD PARTIES THROUGH THE USE OF THE SERVICE OR APPLICATION. YOU ACKNOWLEDGE AND AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE APPLICATION AND SERVICE, AND ANY THIRD-PARTY SERVICES OR PRODUCTS REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnification:

SJS Car Washing LLC will not be liable for any injury, loss or damage of any kind arising from or relating to your failure to comply with (a) and (b) or for any acts or omissions by you or someone else using your Account and/or password. LINKS As a courtesy to you, the Sites may offer links to other websites. Some of these websites may be affiliated with SJS Car Washing LLC while others are not. SJS Car Washing LLC is not responsible for the contents of any website pages created and maintained by organizations independent of SJS Car Washing LLC. Visiting any such third-party website pages is at your own risk. SJS Car Washing LLC has no control of these third-party website pages, nor can it guarantee the accuracy, completeness, or timeliness of information in third-party website pages. Your use of such information is voluntary, and your reliance on such information should be made only after independent review. References to commercial products or services within any such third-party website pages do not constitute or imply an endorsement by SJS Car Washing LLC. By using the Sites you acknowledge that SJS Car Washing LLC is responsible neither for the availability of, nor the content located on or through any third-party website pages. CONSIDERATION You acknowledge that these Terms of Use are supported by reasonable and valuable consideration, the receipt and adequacy of which are hereby acknowledged. Without limiting the foregoing, you acknowledge that such consideration includes, without limitation, your use of the Sites and receipt or use of data, content, products and/or Services through the Sites.

Governing Law:

This Agreement is governed by the laws of Dubai and the laws of the United Arab Emirates as applied in Dubai.

Access to Service Site/Vehicles:

By entering into this Agreement or using the Application or the Service you agree that you will guarantee the access to service site and/or vehicle – be it an individual parking of a villa, apartment parking, community parking, public parking, commercial parking lot, etc. – to SJS Car washing LLC’s staff in order to provide the requested service(s).

Refund & Cancellation Policy:

Any refund will be done only through the original mode of payment

Delivery Policy:

sjscarwash.com or SJS Car Washing LLC will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE. Customer should remove any valuable belongings kept in the car before handing it over. SJS Car washing LLC will not take responsibility for any items that may get misplaced or lost.

Multiple services may result in multiple postings to the cardholder’s monthly statement.

 

COOKIE POLICY:

sjscarwash.com uses cookies in this Website, small text files with information on your navigation in this site whose principal objective is to improve your experience in the website. By accepting this Policy, Customer consents to the use of the cookies used in this Website. Customer may refuse to accept cookies by activating the setting on its browser which allows Customer to refuse the setting of cookies. However, if Customer selects this setting, Customer may be unable to access certain parts of the Website or unable to avail sjscarwash.com’s services. Unless Customer has adjusted its browser setting so that it will refuse cookies, SJS Car Washing LLC  system will issue cookies when Customer logs on to the Website.

  • whenever you are asked to fill in a form on the website, look for the box that you can click to indicate that you do not want the information to be used by anybody for direct marketing purposes
  • if you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by letting us know using our Contact Us information.

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish this to happen.

You may request details of personal information which we hold about you under the Data Protection Act. A small fee will be payable. If you would like a copy of the information held on you please email us this request using our Contact Us information.

If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, at the above address. We will promptly correct any information found to be incorrect.

Dispute Resolution:

Any dispute, claim or controversy arising out of or in connection with this Agreement, including a dispute, claim or controversy arising in relation to its interpretation or relating to any non-contractual obligations arising out of or in connection with this agreement (a “Dispute”) shall be settled amicably between the parties following the receipt by either party of written notice of the Dispute from the other party. In the event that a Dispute cannot be settled amicably within a period of 60 days from the date on which the relevant party notifies the other in writing that a Dispute has arisen, the parties agree that such Dispute shall be referred to and finally settled by arbitration under the DIFC-LCIA Arbitration Rules (the “Rules”), which Rules are deemed to be incorporated by reference into this Agreement. The seat, or legal place, of arbitration shall be the DIFC.

The number of arbitrators shall be three. Each party will nominate one arbitrator for appointment by the LCIA Court. The third arbitrator, who shall act as chairman, shall jointly be nominated by the other arbitrators so nominated and appointed by the LCIA Court.

The language to be used in the arbitration shall be English. ​

This “Dispute Resolution” section will survive any termination of this Agreement.

General:

You agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form, and (b) maintain and promptly update the personal information you provide to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or SJS Car Washing LLC has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, SJS Car Washing LLC has the right to refuse any and all current or future use of the Sites (or any portion thereof) or Services. You are responsible for maintaining the confidentiality and security of your Account and password, and you are fully responsible for all activities that occur under your password or Account, and for any other actions taken in connection with the Account or password. You agree to (a) immediately notify SJS Car Washing LLC of any known or suspected unauthorized use(s) of your password or Account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information; and (b) ensure that you exit from your Account at the end of each session.

  • Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.
  • United Arab of Emirates is our country of domicile.
  • Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website.
  • If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.
  • The cardholder must retain a copy of transaction records and Merchant policies and rules.
  • You are responsible for all damages to your property and SJS Car washing LLC is not liable for any loss or damage incurred.
